Couple Suing Florida Department of Children and Families for Wrongful Death Last month, authorities took a four-week-old baby out of her parents' home and placed her under the care of the state. She, along with her three older brothers, had been taken because of reported medical neglect and allegations that a gun was within the reach of the eldest son. However, during the nine-day time that the small child was kept in a group home for other rescued children, she accidentally suffocated. She had been lying on her stomach with a blanket partially covering her face. When a worker came to check on her crib, he noticed that she was not breathing.
The mother of the child was furious to find out that her baby was not checked on for a period of five hours. However, the managers of the group home say that it was an accident. Though the workers should have known not to wrap a small infant in a blanket, they found no evidence of negligence or wrongdoing during the investigation.
The mother has since suffered many nervous breakdowns and her marriage with her husband has ended. She is planning to press charges for the wrongful death of her tiny daughter and also for her own personal emotional injury.
Oftentimes, a wrongful death case can turn into a personal injury suit, because of the lasting emotional trauma that the unexpected death of a loved one can cause.
