Wife of Deceased Smoker Wins Millions from Phillip Morris In a landmark case against the big tobacco company, Phillip Morris, a Florida woman has recently won a multi-million dollar lawsuit. She claimed that the addictive nature of cigarettes killed her husband, who was a chain smoker for over 40 years, before he died of lung cancer. She said that the advertising practices of the corporation were deceptive and that it managed to hide the dangers of smoking.
Several other individuals and families have tried to sue the tobacco companies for similar reasons. However, they have rarely won. The state courts have said that tobacco companies do knowingly sell dangerous products and conceal the risks of smoking. However, each case must be presented individually and the plaintiff must prove that the deceased was addicted beyond his or her own control.
The defense attorney said that the smoker had tried to quit for over 40 years, employing such techniques as hypnosis and the “cold turkey” method. However, nicotine kept its hold on him and he would always return to cigarettes, despite doctors' warnings to stop. He even continued to smoke throughout his chemotherapy treatment.
Because the defendant won this case, it may open up more doors for individuals, whose lives have been ruined or ended because of a nicotine addiction. If you or someone you love is a chain smoker, contact the law office of Porter and Korvick. The experienced personal injury lawyers will work to make sure that you get every dollar that you deserve.
